What I will and won't do

TERMS OF SERVICE:It is the client's responsibility to read all the terms listed below.In entering into an agreement with JustDandiArt aka Dandi (henceforth referred to simply as “the artist”), you (henceforth referred to interchangeably as the “commissioner” and/or the “client”) agree to abide by the terms of this agreement, as well as any additional terms laid out in separate contracts or agreements accepted by both parties at the time of said agreement’s creation.For the purposes of this document, “work,” “commission,” “project,” “art,” and “artwork” refer to the item or service that the commissioner is soliciting from the artist, “deliverable” refers to the completed file(s) to be delivered to the client upon the completion of the project, “work-in-progress” is defined as any part of the creative process leading to the completion of the commission, and “TOS” may be used in place of “Terms of Service”.In the instance that a disagreement occurs, these terms must first be referred to in the case that guidance for the specific disagreement’s resolution is laid out. If no such resolution is expressly laid out, the resolution will default to the artist’s judgment.

GENERAL TERMS/DISCLAIMERS:The artist reserves the right to refuse or discontinue a commission at any time.Disrespectful behavior will not be tolerated and your commission will be cancelled if it occurs.The terms outlined here may vary slightly depending on the type of commission,PAYMENT & FEES:Payment is due in full upfront.Payment is done through Ko-fi via Stripe using USD.A rush fee will be charged for tight deadlines.A design fee will be charged for clients with no reference images that would like me to draw solely from a description and/or a collection of photos.Additional fees will be charged for excessive or major revisions (see “Revisions” below).The exact prices for the fees described above will be dependent upon the complexity of the commission.CLIENT OBLIGATIONS:Write in a clear and concise manner when filling out the commission form whether through Ko-fi or form that has been sent to you the client.Provide multiple clear reference images of the character/subject.Mood boards are welcome! (pinterest/collage/etc)Maintain professional conduct throughout the commission process.Respond in a timely fashion.It is client responsibility to check for updates. The artist will not make repeated attempts to contact the client regarding commission related updates or approval.Assume responsibility for any important information and clear descriptions/references you fail to provide me that results in my inability to complete your commission to your full satisfaction.Carefully read through the ToS and Commission Information.PROCESS AND TURNAROUND:The artist is disabled so expect some delays to occur that may result in an extended wait time.All commissions are at a max on a 12x16in sRBG canvas. Size is dependent on commission and if you need a certain size for your file for upload reasons please let the artist know beforehand.The artist will maintain communication so the client is aware at all times the state of the commission and whether it is currently being worked on.The artist will contact the client on ko-fi or email at each stage (sketch, lineart, color) to get client approval before continuing. Progress will not continue until each stage is approved.REVISIONS:One major revision and multiple minor revisions are allowed in the sketch phase and are covered in the commission price.A limited amount of minor revisions are allowed in coloring/painting stage and are covered in the commission price.Excessive minor revisions to the point that forward progress on the work has halted will incur additional fees.Revisions due to artist negligence are free.Additional major revisions will incur additional fees.It is up to the artist's discretion as to what constitutes minor and major revisions.COPYRIGHT & USAGE POLICY:I, the artist, retain the rights over any commissioned works.I reserve the right to post the commissioned work on my social media.I reserve the right to stream, record, and upload videos of the creation of the artwork.Any characters portrayed in the commissioned work remain copyrighted to their rightful owners.The final product is strictly for your personal use only, unless you purchase commercial rights.You must credit and link back to me/tag me when sharing or using the commissioned work.For commercial use, you must purchase the rights from me at 300% the original price.Credit is still required when using the work in any form commercially.You may use or edit the commissioned work in the following ways:Print the work for personal use.Crop and/or resize the image for use as an avatar, header, video thumbnail, etc.Use the artwork as reference for a study.Post the artwork on social media, with credit to me clearly visible.You may NOT use or edit the commissioned work in the following ways:Claim the artwork as yours.Remove my watermark/signature.Paint over or otherwise alter the artwork in ways not covered under the allowed uses above.Color in my sketches or lineart.Use the commissioned piece in any technology related to NFTs, cryptocurrency, or AI.Reproduce the work commercially without purchasing the rights from me.CANCELLATION AND REFUNDS:Once the final product is approved, a refund is not permitted.You may cancel the commission any time, after which I will issue a refund equivalent to the amount of work not done.I reserve the right to cancel and refund the money for your commission at any time.You may not file a chargeback against me after you have given approval of the artwork.Any chargeback will result in a ban from commissioning the artist in the future.
